Fulton County District Attorney Fani Willis’ racketeering case against former President Donald Trump, linked to the 2020 election, faces potential upheaval amid allegations that crucial evidence was unlawfully obtained.

A recent book titled “Find Me the Votes: A Hard-Charging Georgia Prosecutor, a Rogue President, and the Plot to Steal an American Election” sheds light on the controversy. According to authors Michael Isikoff and Daniel Klaidman, Georgia Deputy Secretary of State Jordan Fuchs recorded a pivotal phone call between Trump and Georgia Secretary of State Brad Raffensperger. The recording, deemed essential evidence in Willis’ indictment, was allegedly made by Fuchs while she was in Florida, a state requiring consent from all parties involved in a recording.

Legal experts suggest that Trump’s defense team could challenge the admissibility of the recording in court, arguing that it was unlawfully obtained. Despite being leaked to The Washington Post, the tape forms a cornerstone of Willis’ case, portraying Trump pressuring Raffensperger to “find” votes and overturn the election results.

While the book commends Willis’ prosecution efforts, it acknowledges the potential illegality of Fuchs’ actions in recording the call. Fuchs reportedly testified before a Fulton County grand jury under immunity, confirming her role in the recording.

However, the legality of using unlawfully obtained evidence varies across jurisdictions. While some states permit its use, others prohibit it. In Georgia, state law dictates that evidence obtained unlawfully is inadmissible in court, except for proving violations of wiretapping and surveillance laws.

Despite potential legal ramifications in Florida, where the recording occurred, experts suggest that any charges against Fuchs might be limited to misdemeanor offenses. Florida law provides exemptions for recordings made for law enforcement purposes, potentially shielding Fuchs from prosecution.
