Legal analyst Jeffrey Toobin expressed strong confidence that Donald Trump’s petition to the Supreme Court, aiming to overturn a Colorado state Supreme Court decision that barred him from the state’s 2024 ballot under the Constitution’s “insurrectionist ban,” would result in a decisive win for the former president.
Speaking on a morning show, Toobin shared, “I generally refrain from forecasting the outcomes of Supreme Court cases based on the oral arguments. However, this time, I’m willing to make an exception and predict a clear-cut victory for the Trump campaign.”
In the Thursday hearing, justices from both the conservative and liberal wings raised questions about Trump’s potential disqualification from future presidential races due to his actions following the 2020 election loss to Democrat Joe Biden, culminating in the January 6, 2021, Capitol riot.
A key point of discussion among the justices was whether congressional action is necessary before states can apply a post-Civil War constitutional amendment designed to bar individuals who participated in an insurrection from holding office again. There was also debate over whether this provision applies to the presidency.
Toobin observed, “It’s rare to see a contentious case where the justices’ political leanings don’t seem to influence the oral arguments. This time, the agreement among them was almost unanimous.”
